Agreement to Terms
By accessing or using Melomaniac, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not use our service.
Eligibility
You must be at least 13 years old to use Melomaniac. By using the service, you represent that you meet this age requirement. Melomaniac is currently invite-only — you must have a valid referral code from an existing member to create an account.
Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
- Providing a valid email address
Acceptable Use
You agree not to:
- Post spam, harassment, or abusive content
- Impersonate others or misrepresent your identity in a harmful way
- Violate any laws or regulations
- Attempt to gain unauthorised access to the service
- Use automated tools to scrape or collect data
- Post content that infringes copyright or other intellectual property rights
- Interfere with or disrupt the service
Content Ownership
You retain ownership of content you create (liner notes, lists, and other contributions). By posting content, you grant Melomaniac a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your content solely for the purpose of operating and improving the platform.
You represent that you have the right to post the content and that it does not violate any third-party rights.
Content Moderation
We reserve the right to remove content or suspend accounts that violate these terms or our Community Guidelines. We may do so without prior notice.
Membership Tiers
Melomaniac offers three membership tiers: free membership, Founding Melomaniac (available to Phase 1 invite-only members), and Subscriber (paid tier). Paid subscriptions are processed securely via Stripe. We do not store payment information on our servers. Subscription fees are non-refundable except where required by law.
Intellectual Property
The Melomaniac platform, including its design, code, and branding, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the platform without permission.
Third-Party Content
Album and artist information is sourced from MusicBrainz and other public databases. Cover art is sourced from the Cover Art Archive. We respect copyright and respond to valid DMCA notices. See our Copyright Policy.
Disclaimer of Warranties
Melomaniac is provided “as is” without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free.
Limitation of Liability
To the maximum extent permitted by law, Melomaniac shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.
Account Termination
You may delete your account at any time by contacting legal@melomaniac.fm. We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the service ceases immediately.
Changes to Terms
We may modify these terms at any time. We will notify you of significant changes via email or a notice on the platform. Continued use after changes constitutes acceptance of the new terms.
Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales, Australia.
